  1. One room was in my father’s name. I paid Rs.25,000/- for one more attached room 1976, of course I have no proof. My parents and brothers continued to stay there. By 2014, one by one all of them have expired. Now myself and my two niece want to sell the tenancy rights and split it as 1/2, 1/4 and 1/4. We hopte to get abot 40 lacs, 16 lacs will be taken by the owner, and we get them as 12 lacs, 6 lacs and 6 lacs. How do I decide my tax liability. I suppose, if I take the payment by cheque, I will have to treat the entire amount as capital gains from properties. Am I correct. Do I need to take any extra precautions to ensure that no body can harass me on any issue. Thanks.

  2. I have been a tenant since 1961 in a flat in Mumbai. The landlord wants back the property and is willing to pay me goodwill. What is the tax treatment for this amount. What are my options.

    1. Surrender of tenancy right is taxable as long term capital gain. You can purchase another property self occupied or invest in Bonds eligible for such exemptions.

  3. My shop is on rent since last 72 years in Bhavnagar (Gujarat, India),my landlord has sold his entire building (including my shop) to a builder. Now my builder wants me to leave the shop.
