Many housing societies today use WhatsApp groups for quick updates and informal communication. However, when it comes to official matters—such as selling a flat—members often wonder whether details must be shared with the entire group or only with the managing committee (MC). The rules under the cooperative housing society bye-laws clearly define what constitutes valid communication.
WhatsApp Is Not an Official Communication Channel
Though convenient, WhatsApp is not recognised as an official mode of communication under the housing society bye-laws. Any information posted on WhatsApp does not carry legal standing and cannot be considered as valid communication to the society.
This is why the managing committee is correct in stipulating that the seller must formally submit the details to the society.
What the Bye-Laws Say
Bye Law 162 specifically states that notices of meetings or other communications must be sent to members through the following modes:
• Hand delivery
• Registered post / courier
• Email (officially recorded email IDs)
Since these are the only recognised channels, the same rule applies to communications from members to the society.
This means:
• Flat-sale details must be officially communicated to the MC
• WhatsApp sharing is optional and informal, not compulsory
Why WhatsApp Sharing Cannot Be Enforced
Even though sharing the flat details with all members may help the seller find a better buyer, the MC cannot be compelled to use WhatsApp as part of official communication because:
• WhatsApp groups are informal and voluntary
• Some members may not be part of the group
• It does not satisfy the legal requirement for formal notices
• It may lead to privacy or solicitation concerns
However, Members May Voluntarily Share Details
If the seller wishes, they can personally share flat-sale details in the society WhatsApp group for wider visibility. But this is purely voluntary and cannot replace official submission to the MC.
In short:
WhatsApp = Optional, informal
Formal letter/email to MC = Mandatory
Conclusion
To ensure compliance with the bye-laws, flat-sale information must be formally sent to the managing committee. Sharing the same information in the society’s WhatsApp group is optional and unofficial, and cannot be treated as a requirement for the society’s processes.
