Managing Committee Composition Rules for Housing Societies With Less Than 50 Members

The structure of the managing committee in a cooperative housing society is governed by the Maharashtra Cooperative Societies (MCS) Act, 1960 and the amended Chapter XIII-B (Section 154B). The Act clearly defines how many members can be appointed, how many women must be included, and when reservations apply. Understanding these rules ensures the society remains compliant during elections.

How Many Members Can Be Appointed?
Section 154B-9 empowers the State Government to prescribe the strength of the managing committee. As per the applicable government resolutions (GRs dated 27.02.2024 and 28.02.2024), the size of the committee depends on the total number of members in the society.

For societies having less than 50 members, the managing committee must consist of:
• Total Committee Members: 7
This is the maximum prescribed size for such societies.

Mandatory Women Representation
Under Section 154B-21, every society having fewer than 50 members must appoint:
• Minimum 2 women members
These women must be part of the seven-member managing committee.

This requirement ensures inclusivity and representation of women in the decision-making process.

Reservation Requirements
Section 154B-20 deals with reserved seats for:
• Scheduled Castes
• Scheduled Tribes
• Other Backward Classes
• VJNT categories
• Women (in societies larger than 50 members)

However, these reservation rules apply only to societies having more than 50 members.

Since your society has fewer than 50 members:
• Reserved category seats DO NOT apply.
You only need to satisfy the mandatory two-women requirement.

Summary of Requirements for Your Society (<50 Members)
Total managing committee members: 7
Minimum women members: 2
Reserved category representation: Not applicable
Legal basis: Sections 154B-9, 154B-20, 154B-21 of the MCS Act + GRs dated 27/02/2024 and 28/02/2024

Conclusion
A housing society with fewer than 50 members must form a seven-member managing committee that includes at least two women. There is no requirement for reserved category representation. Ensuring these guidelines are followed will make the managing committee election valid and legally compliant.
